Portalis Terms of Service

Company: Portalis (Pty) Ltd ("Portalis," "we," "us," "our")

By accessing or using our website, you agree to be bound by these Terms of Service.

1. About Portalis

Portalis provides a free platform for South African matriculants and students to:

  • Calculate APS scores
  • Match courses based on subjects and interests
  • Access university brochures and prospectuses
  • View user-generated course ratings and comments
  • Optionally purchase application submission services

Our tools are provided "as is" for informational and convenience purposes only.

2. Eligibility

You must be:

  • At least 13 years old to use our free tools
  • At least 18 years old (or have parental consent) to purchase our paid application services

By using Portalis, you confirm that you meet these requirements.

3. Our Free Tools (No Account Required)

Portalis does not require you to create an account to use our APS calculator, course matching tool, brochure library, or to read course comments. You may use these features anonymously.

We do not store your personal information when you use free tools unless you voluntarily choose to contact us or purchase a service.

4. Paid Application Service (Optional)

Portalis offers a paid service where we assist with submitting university applications on your behalf. This service is optional.

4.1 Fees

  • Service fees are clearly displayed before you purchase
  • University application fees (e.g., CAO, direct university fees) are separate and paid directly by you

4.2 No Refund Policy

All service fees are non-refundable. By purchasing our application service, you acknowledge and agree that:

  • We do not guarantee university acceptance
  • We do not guarantee application submission deadlines if you provide incomplete or incorrect information
  • We do not offer refunds for change of mind, missed deadlines caused by your delay, or unsuccessful applications

Reason: Our service involves labour (data entry, form filling, follow-ups). Once performed, that labour cannot be "returned." Consumers are legally entitled to a refund only if the service was not provided at all or was grossly negligent — not for outcomes or buyer's remorse.

4.3 Your Responsibility

You are responsible for:

  • Providing accurate and complete information (ID number, results, course choices)
  • Ensuring you meet minimum university requirements before purchasing
  • Checking your email (including spam folder) for communications from Portalis or universities

Portalis is not liable for rejected applications caused by incorrect information you provide.

5. Anonymous Comments & Course Ratings

Portalis allows registered (optional) and unregistered users to leave anonymous comments and ratings on courses.

5.1 Voluntary Participation

  • You are not required to leave comments or ratings
  • Comments are voluntary and represent your personal opinion
  • You may comment anonymously without providing your name or email

5.2 What You Cannot Post (Prohibited Content)

You agree not to post any comment or rating that:

5.3 Moderation Rights

Portalis reserves the right to:

  • Delete or edit any comment or rating at our sole discretion
  • Ban users (by IP address) who repeatedly violate these rules
  • Share anonymised data with universities for quality improvement (never your identity)

We are not obligated to notify you before removing content.

5.4 Disclaimer on Comments

Comments and ratings are user-generated. Portalis does not verify the accuracy of any user comment. You rely on them at your own risk. We are not liable for any decision you make based on user comments.

6. Intellectual Property (IP)

6.1 What We Own

All content created by Portalis, including but not limited to:

  • APS calculator logic and code
  • Course matching algorithms
  • Website design, layout, and graphics
  • Original blog posts, guides, and written content
  • The Portalis name and logo

is the intellectual property of Portalis (Pty) Ltd and protected by South African copyright and trademark laws.

6.2 What You Own

You retain ownership of:

  • Comments and ratings you post (but you grant us a licence to display them — see below)
  • Your personal information (governed by our Privacy Policy)

6.3 Licence You Grant Us

By posting a comment or rating on Portalis, you grant us a perpetual, worldwide, royalty-free licence to:

  • Display, publish, and share your comment on our website
  • Use anonymised excerpts for promotional or research purposes

You may request deletion of your comment by emailing us (but we cannot guarantee deletion if it has been shared externally).

6.4 Prohibited Use of Our IP

You may not:

  • Copy, reproduce, or resell our APS calculator or course matching logic
  • Use the Portalis name or logo without written permission
  • Scrape our website for commercial purposes

Violation may result in legal action and a claim for damages.

7. Prohibited Activities

When using Portalis, you agree not to:

  • Reporting to relevant authorities (e.g., SAPS Cybercrime Unit)

8. Third-Party Links & Affiliates

Portalis may contain links to:

  • University websites
  • Affiliate partners (accommodation, loans, textbooks)
  • Government sites (NSFAS, DHET)

We are not responsible for the content, privacy practices, or security of third-party websites. You click at your own risk.

Disclosure: Portalis may earn commissions from affiliate links. This does not affect the price you pay.

9. Disclaimer of Warranties

Portalis is provided "as is" and "as available" without any warranties, express or implied.

We do not warrant that:

  • Our APS calculator or course matching is 100% accurate (university requirements change)
  • Your university application will be successful
  • The website will be uninterrupted or error-free
  • User comments are truthful or reliable

You use Portalis at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by South African law:

Portalis (Pty) Ltd, its directors, employees, and affiliates shall not be liable for any:

This limitation applies even if we were advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Portalis (Pty) Ltd, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of our website
  • Any content you post (comments, ratings)
  • Your violation of any third-party rights

12. Termination

We reserve the right to:

  • Suspend or terminate your access to Portalis at any time, without notice, for violation of these Terms
  • Discontinue the website or any feature (with reasonable notice where possible)

You may stop using Portalis at any time.

Upon termination:

  • Your comments may remain visible (but you may request anonymisation)
  • No refunds for unused paid services

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa.

  • We will post the updated Terms on this page with a new "Effective Date"
  • For significant changes, we may also notify you via a website banner or email (if you provided one)

Your continued use of Portalis after changes constitutes acceptance.
